Terms & Conditions

These Terms & Conditions apply to photography services provided by Yann Morel to the person or organisation booking my services the client

.

By making a booking, paying an invoice, or otherwise engaging my photography services, you agree to these Terms & Conditions.

1. Photography Services

The services provided will be those described in your booking confirmation, quotation, package or invoice.

Any additional services, products, hours or deliverables requested after booking may incur additional fees. I will confirm any additional charges with you before providing the additional service where reasonably practicable.

I will use reasonable care and skill in providing my photography services.

2. Booking and Confirmation

A booking is considered confirmed once:

● I have confirmed availability;

● you have accepted the relevant quotation or booking details; and

● any required booking fee or deposit has been paid.

Until the booking is confirmed, I am not required to reserve the requested date or time.

Your booking confirmation, quotation or invoice may contain additional details specific to your photography session. Where there is any inconsistency, the specific booking agreement will take precedence over these general Terms & Conditions to the extent of that inconsistency.

3. Prices and Payment

All prices will be provided in Australian dollars (AUD) unless otherwise stated.

Payment terms will be specified on your invoice or booking confirmation.

Where a deposit or booking fee is required, the amount and whether it is refundable or transferable will be clearly stated before payment.

Any additional services or expenses that you request may be charged separately.

If you fail to make a required payment by the due date, I may pause or decline to provide services until payment is received, subject to my obligations under Australian law.

4. Cancellation by the Client

If you need to cancel your booking, please contact me as soon as possible.

Cancellation fees, deposits and refunds will depend on the terms stated in your booking confirmation and the circumstances of the cancellation.

Nothing in these Terms & Conditions excludes, restricts or modifies any rights or remedies you may have under the Australian Consumer Law.

Where I am legally required to provide a refund or other remedy, these rights will apply regardless of any cancellation policy stated in these Terms & Conditions.

5. Rescheduling

If you need to reschedule a photography session, I will make reasonable efforts to accommodate an alternative date.

Rescheduling is subject to my availability.

Where a new date cannot reasonably be accommodated, the booking may be treated as a cancellation and the applicable cancellation terms may apply.

6. Weather and Outdoor Sessions

For outdoor photography, weather and environmental conditions may affect the safety or practicality of the session.

If I consider weather or environmental conditions unsuitable or unsafe, I may recommend rescheduling the session.

Where reasonably possible, I will discuss alternative arrangements with you, such as changing the location, changing the time or rescheduling.

My decision to postpone a session for safety reasons will be made reasonably and in good faith.

7. Photographer Illness or Unavailability

If I am unable to provide the photography service because of illness, injury, emergency, equipment failure or another circumstance outside my reasonable control, I will make reasonable efforts to:

● reschedule the session;

● arrange a suitable replacement photographer where appropriate and agreed; or

● provide another appropriate remedy.

If the service cannot reasonably be provided, any refund or other remedy will be handled in accordance with the booking agreement and applicable Australian law.

8. Delivery of Photographs

The expected delivery method and estimated delivery timeframe will be communicated to you as part of your booking.

Unless otherwise agreed, photographs will normally be supplied digitally through an online gallery, download link or another electronic method.

Delivery times are estimates and may vary depending on the type and volume of work involved.

If there is an unexpected delay, I will endeavour to keep you informed.

9. Image Selection and Editing

I retain creative control over the selection and editing of photographs unless a different arrangement has been agreed in writing.

My editing style, colour grading, cropping and artistic decisions form part of my photography service.

RAW or unedited files are not included unless specifically agreed in writing.

Minor variations between photographs displayed on different screens, devices or printing systems may occur and do not necessarily constitute a defect.

10. Copyright

Unless otherwise agreed in writing, copyright in the photographs remains with the Photographer.

Purchasing photography services or receiving digital photographs does not automatically transfer copyright ownership to the Client.

I grant you a licence to use the delivered photographs for the purposes and under the conditions specified in your booking agreement.

You must not sell, license, commercially exploit, substantially alter or otherwise use the photographs outside the scope of that licence without my written permission, unless otherwise permitted by law.

11. Personal Use

Where photographs are supplied for personal use, you may generally:

● download and store the photographs;

● print them for personal purposes;

● share them with friends and family; and

● post them on personal social media accounts.

Where you share photographs online, crediting the Photographer is appreciated where reasonably possible.

You must not represent the photographs as your own work or remove copyright or attribution information where doing so would infringe my rights.

12. Commercial Use

Commercial use of photographs requires prior written agreement unless commercial usage is expressly included in your package.

Commercial use may include advertising, marketing, websites, publications, product packaging, paid social media advertising or other business purposes.

Additional licensing fees may apply depending on the intended use.

13. Photographer’s Portfolio and Marketing

Unless you request otherwise in writing, I may use photographs created during your session for my professional portfolio, website, social media, competitions, exhibitions, advertising and other promotional purposes.

If you do not wish for your photographs to be used publicly, please notify me before the photography session.

Where photographs contain identifiable people other than the Client, appropriate consent or other lawful basis for use will be considered where required.

14. Privacy

I will handle personal information in accordance with my Privacy Policy and applicable Australian privacy laws.

Information provided during the booking process will only be collected, used and disclosed for appropriate business purposes, including providing photography services, communicating with you, processing payments and maintaining business records.

15. Client Responsibilities

The Client is responsible for providing accurate information necessary for the photography service, including:

● the correct date, time and location;

● relevant contact details;

● information about special requirements;

● obtaining any permissions or permits required for locations where the Client is responsible for doing so; and

● ensuring that participants arrive on time and are ready for the agreed session.

The Client is also responsible for the behaviour and supervision of children, pets or other participants attending the session, unless otherwise agreed.

16. Locations and Access

Some photography locations may require permits, entry fees or other permissions.

Unless otherwise agreed, costs associated with location access, permits, parking, travel or venue fees may be payable by the Client.

The Client is responsible for ensuring that the Photographer has reasonable access to the agreed location.

17. Safety

I reserve the right to refuse or stop a photography session where I reasonably believe that the environment, behaviour or circumstances present a significant risk to the Photographer, Client, participants or equipment.

This may include dangerous weather, unsafe locations, aggressive behaviour, illegal activity or other serious safety concerns.

Any decision will be made reasonably and with consideration for the circumstances.

18. Equipment

I take reasonable precautions to protect and maintain my photography equipment.

If equipment failure occurs, I will make reasonable efforts to continue providing the service using backup equipment or alternative methods where available.

Where a significant equipment failure prevents the service from being provided, I will discuss reasonable options with you.

19. Force Majeure

I will not be responsible for delays or failure to perform services where this is caused by circumstances beyond my reasonable control.

Examples may include natural disasters, severe weather, government restrictions, accidents, serious illness, venue closure, transport disruption or other unforeseen events.

Where this occurs, I will make reasonable efforts to reschedule or otherwise resolve the situation with you.

20. Limitation of Liability

To the extent permitted by law, I will not be responsible for loss or damage resulting from circumstances outside my reasonable control.

Nothing in these Terms & Conditions excludes, restricts or modifies any consumer guarantee, right or remedy that cannot legally be excluded under the Australian Consumer Law.

Where liability can legally be limited, any limitation will apply only to the extent permitted by law.

21. Australian Consumer Law

Nothing in these Terms & Conditions is intended to exclude, restrict or modify your rights under the Australian Consumer Law (ACL).

The ACL provides consumers with certain guarantees in relation to services, including that services will be provided with acceptable care and skill and, in certain circumstances, within a reasonable time. (ACCC)

If a service does not meet a consumer guarantee, you may have rights to a remedy depending on the circumstances.

22. Complaints and Disputes

If you have a concern about my services, please contact me as soon as reasonably possible so that I have an opportunity to understand the issue and attempt to resolve it.

I will endeavour to resolve complaints fairly and in good faith.

Nothing in this section prevents you from exercising any rights available to you under Australian law.

23. Changes to These Terms

I may update these Terms & Conditions from time to time.

The Terms & Conditions applying to your booking will generally be the version provided to or accepted by you at the time of booking, unless a change is required by law or otherwise agreed between us.

24. Governing Law

These Terms & Conditions are governed by the laws applicable in South Australia, Australia, unless another jurisdiction is required by law.

By booking my photography services, you acknowledge that you have had the opportunity to read and understand these Terms & Conditions.
